Terms of Use

These Terms govern the WindowSeat website, web app, and iOS app. WindowSeat is a focus tool that presents work sessions as calm flights. By using the service, you agree to these Terms to the extent permitted by the law that applies to you.

1. Service provider

WindowSeat is provided by AMRV GbR, An Lyskirchen 7, 50676 Köln, Germany. Contact: trywindowseat@gmail.com. Full provider details are available in the Imprint.

2. Local use and accounts

The local flight experience can be used without an account and is available to all ages. Where local law requires it, a parent or legal guardian should supervise a younger user's use. WindowSeat accounts, cross-device sync, and social features are available only to people aged 16 or older.

Accounts are optional. Web and iOS accounts may use Google or Sign in with Apple. You are responsible for maintaining access to and security of your sign-in provider account and for providing accurate account information. One person must not impersonate another or use a display name that infringes another person's rights.

3. Economy, First Class, and Miles

WindowSeat's Economy experience is available without charge. First Class is an optional paid upgrade. Depending on the platform and offer shown to you, it may be available as a monthly or annual subscription that renews automatically until cancelled, or as a one-time lifetime or Founding Passenger purchase. The applicable price, currency, billing interval, included features, and total due are shown before you place the order.

Web purchases are processed by Stripe. Purchases in the iOS app are processed by Apple and are also subject to Apple's applicable payment and subscription terms. Recurring plans remain active through the paid billing period after cancellation. You can manage an Apple subscription in your Apple account. A web subscription can be ended through the contract cancellation function. Statutory cancellation, refund, and withdrawal rights remain unaffected. See our Withdrawal Information.

WindowSeat Miles are earned through use of the service and can be redeemed only for eligible virtual items shown in the Miles shop. Miles have no cash value, cannot be purchased, sold, transferred, or exchanged for real airline miles, and are not a payment account or financial product. Any expiry rule and the Miles price of an item are shown in the product experience before they apply.

Internet, device, mobile carrier, and third-party service costs remain your responsibility.

4. Permitted use

We grant you a personal, limited, non-exclusive, non-transferable, revocable right to use WindowSeat for lawful personal or internal business productivity, subject to these Terms and the applicable app store rules.

You must not:

  • use the service unlawfully, fraudulently, or abusively;
  • access or attempt to access another person's account or data;
  • interfere with, overload, probe, bypass, or damage the service or its security controls;
  • use automated scraping or extraction except where mandatory law expressly permits it;
  • copy, sell, sublicense, or redistribute the app, code, audiovisual assets, or other protected materials without permission; or
  • use a profile, friend request, invitation, or shared item to harass, deceive, threaten, or infringe the rights of another person.

5. Social and sharing features

If you enable friend requests, your display name and optional avatar may be searchable by other signed-in users. Accepted friends may see information permitted by your social privacy settings, and friends may send requests or fly-together invitations. You are responsible for the display name and content you choose to share. Do not include personal or confidential information that you do not want others to receive.

You can report or block a profile from the relevant profile or social menu. We may investigate reports, restrict abusive accounts, and preserve limited records where reasonably necessary to protect users, enforce these Terms, or comply with law.

You retain any rights you have in content you provide. You grant us the limited rights needed to host, format, transmit, and display that content solely to operate the feature you requested. This permission ends when the content or account is deleted, except for copies already shared by you or retained where legally required.

6. Focus Mode and notifications

Cabin Door and related focus controls depend on Apple's Screen Time frameworks, device permissions, operating-system behavior, and the selections you make. Notifications and timers can be delayed, silenced, interrupted, or unavailable. Do not rely on WindowSeat for alarms, emergencies, safety-critical timing, or any purpose where a missed or inaccurate notification could cause harm.

7. No professional advice

WindowSeat is a general productivity and focus tool. It is not medical, psychological, legal, financial, or other professional advice and is not intended to diagnose, treat, or prevent any condition. Decide for yourself when to work, rest, or stop a session.

8. Intellectual property

WindowSeat's software, interface, branding, text, graphics, audio, video, and other materials are owned by AMRV GbR or the relevant licensors and are protected by intellectual-property laws. These Terms do not transfer ownership to you. Third-party names and trademarks belong to their owners.

9. Third-party services

WindowSeat relies on services provided by Apple, Google, Stripe, Supabase, Vercel, and Sentry and may link to other services. Their own terms and privacy policies apply to their services. We are not responsible for content or conduct controlled by an independent third party, but this does not limit any responsibility we have under mandatory law for our choice or use of processors.

10. Availability and changes

We aim to keep WindowSeat reliable, but we do not promise uninterrupted availability or that every device, integration, timer, media file, notification, sync, or social feature will always work without error. We may maintain, secure, improve, change, or discontinue features. We will take reasonable account of users' interests and provide notice where mandatory law or a material adverse change requires it.

11. Suspension, termination, and deletion

You can stop using WindowSeat at any time. A signed-in user can delete the account in Profile on the web or in the iOS app; support can also assist with an account request. Account deletion ends the account relationship and deletes associated online data as described in the Privacy Policy.

Deleting a WindowSeat account does not by itself cancel a subscription billed by Stripe or Apple. Cancel an active subscription through the relevant billing provider or the web cancellation function before deleting your account to prevent future renewals. Deletion does not affect statutory rights or records that we must retain by law.

We may restrict or suspend access where reasonably necessary to protect users or the service, respond to unlawful conduct, or address a material breach of these Terms. Except where urgent action is needed, we will consider the circumstances and allow a reasonable opportunity to resolve a remediable issue.

12. Warranty and liability

Your statutory rights, including mandatory consumer rights, remain unaffected. We are liable without limitation for intent and gross negligence; injury to life, body, or health; guarantees expressly given; fraudulent concealment; and liability that cannot lawfully be excluded, including under the German Product Liability Act.

For ordinary negligence, we are liable only for breach of an essential contractual obligation whose performance is necessary for the proper use of the service and on which you could reasonably rely. In that case, liability is limited to the loss that was typical and reasonably foreseeable when the relationship began. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law.

13. Governing law and consumer rights

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country in which you are habitually resident. Courts have jurisdiction only as provided by applicable law.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Updates to these Terms

We may update these Terms for future use when the service, law, or security requirements change. The current version and its date will be available here. If a material change affects an existing account relationship, we will give reasonable notice and request agreement where the law requires it.
